  • Data Loss: Artventory shall not be held liable for any loss, corruption, or unintentional deletion of your artwork records, image files, or business data resulting from system crashes, hardware failures, improper application closure, or user error.

3. Software Provided “As-Is”

The Application is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, Artventory explicitly disclaims all warranties, including but not limited to:

  • No Financial or Legal Advice: Reports, summaries, or valuation outputs generated by Artventory are for organizational and informational purposes only. They do not constitute official accounting, tax, legal, or appraisal advice.
  • User Verification: You are responsible for verifying all pricing, tax rates, sales numbers, and inventory valuations before submitting data for tax filings, insurance claims, or legal contracts.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ARTVENTORY, ITS DEVELOPER, OR AFFILIATED ENTITIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, regardless of the cause, including without limitation:

  • Loss of business, profits, revenue, data or business opportunities.
  • Loss or corruption of data, goodwill, or artwork inventory records.
  • Work stoppage, computer failure, or system malfunction.

Under no circumstances shall the total aggregate liability arising out of or related to your use of the Application exceed the actual amount paid by you for the Application license, or $50 USD, whichever is lower.

Our liability is capped to ensure financial stability proportional to the fees you pay.

Our total aggregate liability for any and all claims arising out of or relating to this Agreement or the Service shall be strictly limited to the total fees you paid us in the twelve (12) months preceding the claim.
